Terms of Service

Agreement

Qinsight Technologies Inc. provides its software platform, website features and related software and services. Access or use is conditioned on acceptance of the applicable terms. A person accepting on behalf of an organization represents that they have authority to bind that organization.

Privacy and electronic communications

Use of the Services is also governed by Qinsight’s Privacy Policy. Electronic communications, including email, website notices and platform messages, may be used for notices and service communications as permitted by law.

License and access

Subject to compliance with the Terms and payment of applicable fees, Qinsight grants a limited, non-exclusive, non-transferable and non-sublicensable right to use the Services for internal business purposes.

The license does not authorize resale, unauthorized commercial exploitation, reverse engineering, creation of derivative works, unauthorized data or source-code extraction, or automated extraction using robots or similar tools. Rights not expressly granted remain reserved.

Intellectual property

Qinsight and its licensors retain rights in the Services, software, content, compilation, trademarks, trade dress and branding, subject to applicable third-party rights.

Customer data and submissions

Customers retain ownership of data or content they submit. The current Terms grant Qinsight the rights needed to process that data for providing and improving the Services. Feedback and suggestions are addressed separately in the published Terms.

No unlawful or prohibited use

Users may not use the Services unlawfully, interfere with operation, damage or disable the Services, or attempt unauthorized access to accounts, systems or networks.

Product descriptions

Product information is provided in good faith, but the currently published Terms disclaim warranties that descriptions or other content will always be complete, current or error-free.

Export and sanctions

Use of the Services is subject to applicable U.S. export, re-export and sanctions restrictions.

Disclaimer of warranties

The current Terms provide the Services on an “as is” and “as available” basis and disclaim implied warranties to the maximum extent permitted by law, including merchantability, fitness for a particular purpose and non-infringement.

Limitation of liability

The published Terms limit certain indirect, incidental, punitive and consequential damages and cap aggregate liability by reference to fees paid during the preceding twelve months, subject to applicable law and any controlling agreement.

Termination

Qinsight may suspend or terminate access for violation of the Terms. Provisions intended by their nature to survive termination continue to apply.

Governing law

Current live wording requires completion: the published Terms refer to the laws of the State of Delaware.

Changes and contact
